Terms of Use: The Elite Solution Consultant™ Toolkit

These terms explain how you may use the free tools on this site. They are written to be read, not to trip you up. The short version: use the tools in your work and with your team, share the link freely, and ask before you sell, republish, or build them into something paid.

1. Who we are

This site and the tools on it are created and owned by Howard Leary II, author of The Elite Solution Consultant (“I,” “me,” or “my”). When you download or use the tools, you agree to these terms.

2. What these terms cover

These terms apply to the worksheets, templates, guides, scorecards, frameworks, and other files offered on this site, in any format, and to any copies or adapted versions you make (together, “the Tools”).

3. Who owns the Tools

The Tools are protected by copyright and are owned by Howard Leary II. Downloading a Tool gives you permission to use it as described below. It does not transfer ownership.

4. What you may do

You may, at no cost:

Download, print, and use the Tools in your own work.
Share the Tools with colleagues inside your own company or organization.
Adapt copies of the Tools for internal use by you or your team, for example adding your own fields, examples, or company terminology.
Use the Tools with your own customers during a sales cycle or engagement where you are not charging for the Tool itself, for example a completed close plan or scorecard shared with a customer.
Quote short excerpts in articles, posts, or presentations, with credit as described in section 6.
Share the link to this page with anyone.

5. What you may not do without written permission

Sell the Tools, or include them in any product, course, training program, template pack, or membership that people pay for.
Use the Tools as part of a paid consulting, coaching, or training engagement that you deliver to another organization.
Post, upload, or distribute the files publicly on another website, shared drive, marketplace, or social platform. Share the link to this page instead.
Remove or change the copyright notice, logo, or branding on any Tool, including on adapted versions.
Present the Tools, or adapted versions, as your own original work.
Use the Tools, or their content, to train, fine-tune, or build an artificial intelligence or machine learning model or dataset.

If you would like to do any of these, ask. Many requests can be approved. See section 12.

6. Giving credit

When you quote, reference, or show a Tool outside your own organization, please credit it as:

7. Trademarks

The Elite Solution Consultant™, The Presales BOAT System™, and the related names and logos are trademarks of Howard Leary II. These terms do not give you permission to use them to name or promote your own products, services, or programs, or in a way that suggests I endorse you.

8. The Tools are guidance, not guarantees

The Tools share practices and frameworks from experience in enterprise software sales. They are provided “as is,” without warranties of any kind, express or implied. Results depend on how they are used and on circumstances I cannot control. You are responsible for how you apply them, and for checking that your use fits your company’s policies and any agreements you have with customers.

Examples in the Tools, including companies, people, and figures, are fictitious or illustrative unless stated otherwise.

9. Limitation of liability

To the fullest extent the law allows, I am not liable for any loss or damage arising from your use of, or inability to use, the Tools, including lost revenue, lost deals, or business interruption.

10. Your information

If you provide your email address to access the Tools, it is handled as described in the [Privacy Policy](link). You can unsubscribe from emails at any time.

11. Changes to these terms

I may update these terms from time to time. The date at the top shows when they last changed. Using the Tools after a change means you accept the updated terms.

These terms are governed by the laws of the State of Florida, United States.
